Product Liability Laws
Product liability law holds anyone along a product’s supply chain – including automobile designers, engineers, manufacturers, distributors, and dealers – liable for injuries and damages sustained as a result of a dangerous or defective product. Product liability lawsuits can be brought based on design defects, manufacturing defects, or marketing defects.
In Illinois, strict liability laws apply to auto manufacturers and dealers and they can be held liable for injuries caused by defective automobiles if (1) the product was defective and unreasonably dangerous for its intended purpose; (2) the defect existed when the product left the vehicle manufacturer; and (3) the defective vehicle caused the plaintiff’s injury.
