The Chicago medical malpractice lawyers recently reached two multi-million dollar settlements in medical malpractice lawsuits, including a $3.25 million settlement that was reached in a wrongful death lawsuit stemming from the death of Teresa Ochoa who died as a result of an untreated brain aneurysm and a $2.75 million settlement on behalf of a woman whose cancer went undiagnosed for four years and is now irreversible.
As alleged in Gloria Ochoa v. Alexian Brothers Medical Center, et al., No. 08 L 14126, Ms. Ochoa suffered from migraine headaches and had been receiving treatment for several years from DuPage Medical Group. In December 2006, Ochoa went to Alexian Brothers Medical Center complaining of an unusually severe headache where she received a pain shot and was sent home. Over the next several days, she visited doctors at both Alexian Brothers and DuPage Medical Center and received medication for a sinus infection and pain shots. At no time did she receive any radiographic studies to determine if a more serious condition was involved. Several days later she was taken to Elmhurst Memorial Hospital where she was diagnosed with an untreated aneurysm and, six days later, she died as a result of bleeding in her brain.
As alleged in the lawsuit, the failure to conduct the appropriate medical tests caused Ms. Ochoa’s death because she lost the opportunity to receive the necessary medical treatment.
In the case of Lee Weis and Ronald Weis v. Northshore University Healthsystems Faculty Practice Associates, No. 11 L 6475, doctors allegedly failed to order the additional testing necessary diagnose a malignant tumor in the patient, despite several indications of an abnormal mass. Over the course of two years, the abnormal mass continued to increase in size, but the appropriate testing was not ordered. By the time the appropriate testing was done, the patient’s tumor and cancer had metastasized in her lymph nodes and spine.
